Regular Meeting # May 28, 2003

Present were Mayor Martin, Councilmembers Callis, Damon, Learey and Sincell. Also present were Linda Fike, Mike Mullen, Steve Eichorn, Mr. & Mrs. Joseph Wooddell, Mr. & Mrs. James Munford, Betsey Whittlesey, Elizabeth Hebb, Mr. & Mrs. Creigh Teets, Nancy Learey, Melissa Wolfe and Judy Paugh, Clerk Treasurer.

Meeting called to order at 6:00 P.M.

Pledge of Allegiance All meetings are recorded.

New Councilmember: Mayor Martin swore Linda Fike into office.

Public Hearing: Mayor Martin read the summary of the Enforcement Ordinance - Ordinance No. 2003-1. Motion by Councilman Learey to accept Ordinance No. 2003-1-Enforcement Ordinance. Seconded by Councilman Sincell. All approved. Motion carried.

Minutes: Motion by Councilman Sincell to approve the minutes of April 30, 2003 and May 12, 2003. Seconded by Councilman Damon. All approved. Motion carried.

Financial Reports: Motion by Councilman Learey to approved the financial reports for May, 2003. Seconded by Councilman Callis. All approved. Motion carried.

Budget Adjustments: Motion by Councilman Sincell to approved the budget adjustments for May, 2003. Seconded by Councilman Learey. All approved. Motion carried.

Ordinance No. 2003 - 5 Sewer Rate Ordinance Repeal: Mayor Martin introduced Ordinance No. 2003-5-Sewer Rate Ordinance Repeal. The public hearing will be held on June 25, 2003 at 6:00 P.M.

Ordinance No. 2003-6 Sewer Rate Ordinance: Mayor Martin introduced Ordinance No. 2003-6 -Sewer Rate Ordinance. The public hearing will be held on June 25, 2003 at 6:00 P.M.

Ordinance No. 2003-3 Zoning Ordinance Amendment for Municipal Infractions: Councilman Sincell (reading for Mayor Martin) introduced Ordinance No. 2003-3 - Zoning Ordinance Amendment for Municipal Infractions. The public hearing will be held on June 25, 2003, at 6:00 P.M.

Mowing of Town Properties: Motion by Councilman Learey to award the mowing contract to Appalachian Parent Assoc. Seconded by Councilman Damon. All approved. Motion carried.

Sewer Tap Refund: Motion by Councilman Callis to deny the refund of $250.00 to Helen Fitzwater for a sewer tap she had purchased in 1986 for her I Street property. Seconded by Councilman Learey. All approved. Motion carried.

Agreement for Operation and Maintenance Services for MLP Wastewater Collection System: Motion by Councilman Sincell to approve the agreement between the Garrett County Department of Public Utilities and the Town. Seconded by Councilman Learey. All approved. Motion carried.

Letter from Jack Turney/Ernie Martin, 402 Spruce Street: Mayor Martin read the letter from Jack Turney for his client Ernie Martin. Council agreed for Mayor Martin to discuss this letter with the Town’s attorney William Rudd.

Brush pick up in MLP: Council agreed to implement a policy to limit brush pick up to small amounts of yard waste and clippings to the last Friday of each month. An advertisement will be placed in the Republican.

Infiltration Study for Little Youghiogheny into MLP Wastewater lines: Motion by Councilman Sincell to approve the infiltration study by the Garrett County Department o

f Public Utilities, with the condition that the Town of Mountain Lake Park must approve the project cost before proceeding. Mayor Martin informed the residents present that the regular meeting is closed. The reason for closing the regular meeting is State Government Article 10-508(a).

Topic to be discussed: Acquisition of Real Estate.

Reason for closing: Authority under Maryland Article 10-508 (a).

Closing of Regular Meeting: Motion by Councilman Sincell to close the regular meeting and go into executive session. Seconded by Councilman Callis. All approved. Motion carried.
