Public Hearing
Zoning Ordinance Amendment
July 2, 2003

Present were Mayor Martin, Councilmembers Callis, Damon, Learey, Fike and Sincell. Also
present were William Rudd, Town’s Attorney, several residents from Mountain Lake Park and the
Town of Oakland, Melissa Wolfe, and Judy Paugh, Clerk Treasurer.

Public Hearing called to order at 6:00 P.M.

Pledge of Allegiance.

Public Hearings are recorded.

Petition from the Town of Oakland:
Motion by Councilman Learey to accept Oakland’s petition to change the Mountain Lake Park
Zoning Ordinance into the records. Seconded by Councilman Callis. All approved. Motion
carried.

Letters supporting or opposing the change to MLP’s Zoning Ordinance:
Motion by Councilman Callis to accept 2 letters supporting the change and 14 letters opposing the
change into the records. Seconded by Councilwoman Fike. All approved. Motion carried.

Planning Commission Recommendation:
Motion by Councilman Sincell to accept the MLPs Planning Commission’s recommendation
opposing the Amendment into the record. Seconded by Councilman Learey. All approved.
Motion carried.

Mayor Martin read the 11 factors from the Mountain Lake Park’s Zoning Ordinance, Section
1104- General Criteria, Section 1105 - Amendments to the Zoning Ordinance Regulations, that
must be considered by the Mayor and Town Council to make a Facting of Fact.

Mayor Martin stated the Finding of Facts will be presented at the next meeting of the Mayor and
Town Council which will be held on July 22, 2003, beginning at 8:00 p.m., place of meeting will be
advertised (probably will be held at Yough Glades Elementary School Auditorium).

Limit Testimony:
Motion by Councilman Learey to limit testimony to 3 minutes per person except for the Town of
Oakland which will have 10 minutes. Seconded by Councilman Callis. All approved. Motion
carried.

Mayor Martin informed the public the record of this meeting and this matter will remain open for
one week for written testimony or letters.
Testimonies heard at the public hearing are on tape and are on file at the Town Hall of Mountain
Lake Park.

Public Hearing Adjourned:
Motion by Councilman Sincell to adjourn the public hearing. Seconded by Councilman Learey. All
approved. Motion carried.
